Employment Contracts
Macau recognizes both fixed-term and indefinite-term employment contracts.
Fixed-term contracts must be based on objective business reasons, including:
• Seasonal work
• Project-based roles
• Temporary replacement positions
Key compliance rules:
• Maximum duration (including renewals): 2 years
• Maximum renewals: 2 times
Exceeding these limits automatically converts the contract into an indefinite-term employment agreement.
Probation periods:
• Indefinite-term contracts: 90 days
• Fixed-term contracts: 30 days
Working Hours & Overtime Rules
Standard working hours in Macau:
• 8 hours per day
• 48 hours per week
Overtime compensation:
• Employer-required overtime: regular salary + 50%
• Mutually agreed overtime: regular salary + 20%
Minimum Wage & Employer Costs in Macau
Macau Minimum Wage (2026)
• Monthly salary: MOP 7,280
• Hourly wage: MOP 35
Mandatory employer contributions:
Social Security Contributions
• Indefinite-term employees: MOP 90/month, employer pays MOP 60
• Fixed-term employees:
– 15+ working days/month: MOP 90/month, employer pays MOP 60
– Less than 15 working days/month: MOP 45/month, employer pays MOP 30
Non-Resident Worker Employment Fee
Employers are required to pay MOP 200/month per foreign employee.
Employee Leave Entitlements
Annual Leave: 6 working days after completing 1 year of service
Paid Sick Leave: 6 paid days per year
Maternity Leave: 70 days
Paternity Leave: 5 working days
Employee Termination & Compliance
After probation, employers must provide 30 days’ written notice for termination.
For dismissal with justified cause, employers must issue written notice within 30 days after becoming aware of the relevant facts and clearly explain the reason for termination.
