Romania Employment Guide

Romania is in Eastern Europe, adjacent to the Black Sea and located at a major European transportation hub. It has ~19 million people; key industries include auto manufacturing, IT, energy, agriculture and services, with Bucharest as the capital and economic center. As an EU member state, it has relatively low labor costs but high education levels and multilingual capabilities, attracting many foreign-funded enterprises. Its labor laws are mainly regulated by the Labor Code, emphasizing the written form of labor contracts. The standard workweek is 40 hours, and employers are required to guarantee minimum wages and social insurance. Employment relations are relatively stable, with dismissals requiring valid reasons and compliance with dismissal procedures.

Maternity Leave Policy

Employees who have completed at least six months of service within the past year are entitled to 126 days of paid maternity leave. A mandatory 42-day postnatal leave period must be taken immediately following childbirth. The National Social Security Fund provides compensation equivalent to 85% of the employee's average earnings over the previous 12 months.

This leave period cannot be extended beyond the statutory allowance.

Paternity Leave Benefits

Employees enrolled in the national social insurance system qualify for 10 days of fully paid paternity leave at 100% of their regular salary, funded directly by the employer. An additional 5-day extension is available for employees who complete accredited parenting courses, bringing the maximum entitlement to 15 days.

For example, SailGlobal implemented this policy last year, resulting in 78% of new fathers taking extended leave to support family bonding.

Parental Leave Provisions

All employees are eligible for up to two years of unpaid parental leave, extended to three years for parents of children with disabilities. Unused maternity leave portions can be transferred to the father, promoting equitable family responsibility sharing.

During parental leave, families may receive state childcare allowances calculated at 85% of the average net income earned during any 12-month period within the two years preceding the child's birth.

Sick Leave Regulations

The annual sick leave entitlement covers up to 90 calendar days with pay. Employers cover the first five days, while subsequent days are reimbursed by the National Health Insurance Agency. Compensation rates range from 75% to 100% of regular wages depending on medical circumstances.

With specialist medical approval, sick leave can be extended to a maximum of 183 days from the initial date of illness within the same calendar year.
